Aarna XP Private Limited (herein referred as the “Company”) is a company registered under the provisions of Companies Act, 2013 having its registered office at Plot Nos. 114-116, Silpi Gafoor Nagar, Madhapur, Hyderabad, Shaikpet, Telangana, 500081. Company owns and maintains the website “https://aarna.global” and the mobile application “Aarna” (collectively, the “Platform”).                                

  1. Applicability of the Terms 

    1. This Terms and Conditions (the “Terms”) herein, read along with the Privacy and Cookie Policy and the Terms of Use available on the Platform, sets out the terms and conditions for availing the services offered by the Platform and your participation as a User, Creator or Host, as applicable, using our services (“Services”).  

    2. For the purpose of these Terms, along with any amendments to the same, and wherever the context so requires “You”, “Your(s)”, “Yourself”, “User”, “Creator(s)” or “Host(s)” shall refer to any natural or legal person who has agreed to become user or creator or host a access or use the Platform, as applicable, including any individual who views, accesses, inquires about, purchases, registers for, or lists any products or services, uploads or posts any content or materials or information, offers or avails services, connects through APIs, or otherwise uses the Platform in any manner. 

    3. You hereby agree and acknowledge that by accessing or using the Services offered by the Company, you hereby expressly confirm that you have read, understood and agree to comply with and be bound by the Terms.   

    4. In the event, you do not agree to any or all of the Terms, you are requested not to access and use any of the Services offered by the Company and/or the Platform. 

    5. You understand that the Company may amend the Terms related to the Services from time to time as it may deem fit and necessary. Any amendment to the Terms shall be effective upon Company’s posting of such updated Terms on the Platform and there shall not be any specific notice for the same, and you agree to be updated with the latest amendments, alteration or modifications, so made by the Company in the Terms.  


  1. Registration

    1. You initiating the sign-up process and creating an authenticated account (“Account”) to access and use the Services. You acknowledge that your continued use of the Platform as a Host shall be subject to compliance with these Terms. 

    2. You agree and acknowledge that you shall:

      1. create only 1 (one) Account using your credentials unless approved expressly in writing by the Company;

      2. provide accurate, truthful, current and complete information when creating your Account and in all your dealings through the Company;

      3. maintain the security of your Account by not sharing your password with others and restricting access to your Account; and

      4. promptly notify the Company if you discover or otherwise suspect any security breaches relating to the Platform.

    3. You agree and acknowledge that any and all activity undertaken by you from the Account shall be your sole responsibility and the Company shall not be responsible or liable for the same in any manner towards you or any other third-party. 

    4. In the event, the Company finds the information, so provided by you, to be untrue, inaccurate, outdated, or incomplete, then it shall be entitled to terminate your Account and refuse current or future use of any and/or all of the Services and you shall be liable to indemnify and hold harmless the Company and/or its affiliates, directors, employees, and agents to the extent of the loss incurred. 

    5. The Company shall not be liable to you or any third-party for any loss or damage arising from the failure on your part to comply with the provision of these Terms. Further, you agree to indemnify and hold the Company and/or its affiliates, directors, employees, and agents harmless from any claims or damages suffered by the Company and/or its affiliates, directors, employees, and agents due to any use of the Account.  

    6. As a User, you would utilize the Platform to search, plan, book and experience travel-related services. This includes looking up destinations, itineraries, accommodations, activities, and tips; booking services such as flights, hotels, and tours; and engaging with curated content provided by experts on the Platform. Users personalize their travel experiences by setting preferences and customizing itineraries, and they also contribute by leaving reviews, ratings, or sharing their travel experiences. Essentially, the Users is the traveller who interacts with the Platform to make informed and convenient travel decisions.

    7. As a host you may offer in-person or virtual travel-related services such as unique experiences, guided tours, accommodations, transportation, food and dining experiences or curated travel support directly to User through the Platform (“Host(s)”). Hosts can be individuals or small businesses who leverage their local knowledge, cultural insights, or hospitality resources to create memorable travel moments. Host types may include, but are not limited to (i) accommodation Hosts (such as homestay providers, vacation rental hosts, hostel operators, hotel partners and boutique property owners), (ii) experience Hosts (including local guides, activity instructors, cultural experts, and event organizers), (iii) transport providers (such as car rental hosts, bike/scooter rental vendors, airport/local transfer operators and boat or yacht hosts), (iv) food & dining Hosts (including home chefs, themed dining event organizers, and cooking class instructors), (v) local experience Hosts (such as art and craft workshop hosts, marketplace guides and wellness facilitators) and (vi) professional operators (including tour companies, concierge services and travel planners).

    8. The Host shall be responsible for the role applicable to its category and, in all cases, and shall (i) create and maintain accurate, up-to-date listings (description, pricing, availability, inclusions, restrictions); (ii) obtain and keep current all licences, permits, insurance, and regulatory compliances required for their services; (iii) ensure safety, hygiene, and service quality consistent with their listing and applicable law; (iv) communicate promptly and courteously with Users and respond to queries, changes, or issues and (v) honour confirmed bookings and manage cancellations, refunds or service modifications in accordance with Platform policies. By listing their services on the Platform, the Host gains access to a broader audience of travellers while contributing authentic, localized and diverse offerings to the travel ecosystem.

    9. As a content creator you shall upload original media such as photos, videos, articles and other forms of digital content intended to educate, promote or entertain the Users through the Platform (“Content Creator”). You may share your personal travel experiences, itineraries, tour packages, events, activities, workshops, insights, tips and recommendations to inspire and inform the Platform’s audience. The content can serve multiple purposes: educational (offering travel advice or destination guides), promotional (highlighting specific services, destinations, or experiences) or entertainment (providing engaging, visually appealing content for travel enthusiasts.

    10. As an influencer you shall use your presence and influence to promote travel experiences and destinations through the Platform (“Influencer”). Influencers typically have a loyal audience who trusts their opinions and recommendations, making them powerful advocates for brands, services, and travel products. You shall collaborate with the Platform or its partners to promote specific destinations, activities, accommodations, events, activities, tours or packages through sponsored posts, videos, or other forms of content. Your content may combine entertainment with recommendations, offering followers an authentic and engaging portrayal of travel experiences.

    11. As a partner you shall be a trade association, agency or any other entity engaged in the management of Influencers and/or Content Creators (“Partner”). You shall promote, market and sell curated experiences, itineraries, tour packages, events, activities and workshops to the Users. You shall provide your portfolio of experiences on the Platform, including necessary details such as pricing, availability, conditions, cancellations and date change policy and other limitations related to the experiences. You shall maintain an accurate inventory and communicate all limitations regarding availability of the experiences on the Platform, especially when there are restrictions on the number of participants or other conditions.

    12. The Influencer, Partner and Content Creators are collectively referred to as the “Creators” and individually as the “Creator” under this Terms.


  1. Your Obligations

    1. You will be eligible to use the Services only by registering on the Platform with the Company and fulfilling following qualifications:  

      1. You must be above the legal age of 18 (eighteen) years; and

      2. You must have the legal capacity to enter into contract and must not be specifically disqualified. 

    2. You undertake not to: 

      1. Cut, copy, distribute, modify, recreate, reverse engineer, distribute, post, publish or create derivative works from, transfer, or sell any information or software obtained from the Platform. For the removal of doubt, it is clarified that unlimited or wholesale reproduction, copying of the content for commercial or non-commercial purposes and unwarranted modification of data and information within the content of the Platform is not permitted. 

      2. Develop, support or use software, devices, scripts, robots or any other means or processes (including crawlers, browser plugins and add-ons or any other technology) to scrape the Services or otherwise copy any profile or other data from the Services and/or Platform.

      3. Access (or attempt to access) the Platform and/or the materials or Services by any means other than through the interface that is provided by the Platform. You may be exposed to content from other Users, Creators, Hosts or third parties that you may consider offensive, indecent or otherwise objectionable. We disclaim all liabilities arising in relation to such offensive content on the Platform. Further, you may report such offensive content.

      4. Use the Platform in any manner that may impair, overburden, damage, disable or otherwise compromise the Platform.  

      5. Use the User information made available through Platform to further any unlawful purposes or to conduct any unlawful activity, including, but not limited to, fraud, embezzlement, money laundering or identity theft.  

      6. Use the User information made available through Platform to abuse, harass, threaten, defame, disillusion, erode, abrogate, demean or otherwise violate the legal rights of others;    

      7. Violate any code of conduct or other guidelines, which may be applicable for or to any particular Service;

      8. Infringe any intellectual property rights;

      9. Misrepresent your affiliation with the Company;

      10. Collect or harvest any information about other Users, Creators or Hosts without their consent;

      11. Upload harmful, misleading, offensive, or illegal content; and

      12. You are also prohibited from violating the security of the Platform. In case of any violations of system or network security, the Company shall be entitled to take necessary remedial actions including but not limited to taking any civil or criminal action.       

    3. Further, you shall not display, upload, publish, modify, store, update, transmit or share any content on the Platform which:

      1. belongs to a third-party and to which the User does not have any right, including photographs, videos, or reviews copied from third-party platforms or sources;

      2. is defamatory, obscene, pornographic, paedophilic, invasive of a third-party’s privacy including bodily privacy, insulting or harassing on the basis of gender, racially or ethnically objectionable, relating or encouraging money laundering or gambling, or promoting enmity between different groups on the grounds of religion or caste with the intent to incite violence;

      3. contains content that may harm children, including inappropriate recommendations for child travellers or exposing minors to unsafe locations or interactions;

      4. infringes any patent, trademark, copyright, or other proprietary rights;

      5. deceives or misleads the addressee about the origin of the message or knowingly and intentionally communicates any misinformation or information which is patently false and untrue or misleading in nature;

      6. impersonates another individual, User, Creator, Host, travel business, or uses fake booking accounts or reviews to manipulate platform trust and ratings;

      7. misuses or manipulates booking systems (e.g., using fake payment methods, initiating chargebacks without valid cause, or abusing cancellation policies);

      8. threatens the unity, integrity, defence, security or sovereignty of India, friendly relations with foreign states, or public order, or causes incitement to the commission of any cognisable offence, or prevents investigation of any offence, or is insulting other nation; or

      9. violates any local and applicable law for the time being in force.


  1. Specific Terms and Conditions for Users

  1. As a User, you agree that:

    1. You represent and warrant that any content uploaded, submitted or otherwise provided through the Platform is your original work or is properly licensed. You warrant that the content uploaded by you does not infringe upon any third-party intellectual property, proprietary or other rights. You shall be solely responsible for your content posted on the Platform and any consequences thereof.

    2. You are responsible for ensuring that the information and content related to any unmanaged experience published on the Platform is accurate and up to date.

    3. You represent and warrant that your use of the Platform shall all times comply with the applicable laws, rules and regulations of their respective countries, including but not limited to data protection, IT and online content laws.

    4. You acknowledge and understand that the Company uses in-house AI or GAI to assist you in generating details and information for your content based on your inputs. However, you shall review such content and finalise the content before publishing it on the Platform. 

    5. By uploading content, you grant the Company a worldwide, perpetual, royalty-free, non-exclusive license to: (a) use, reproduce, modify, adapt, publish, translate, create derivative works, and distribute the content; (b) display the content on the Platform, associated websites, and social media channels; (c) use the content in marketing, promotional materials, and commercial projects. The Company may do so either manually through human intervention or through the application of AI or GAI technologies, as the Company deems necessary, for the purpose of listing, promoting, and showcasing the unmanaged experiences on its Platform. This includes, but is not limited to, the creation of custom visuals, captions, or alterations to the format of the content, to best align with the presentation and functionality of the Platform. You acknowledge that you have no right to any compensation, credit, or acknowledgment for any use of your content under this license.

    6. To the maximum extent permitted by applicable law, you waive any “moral rights” or similar rights you may have in your content, such as the right to object to modifications, transformations, or other changes to your content.

    7. You shall only use the music tracks, sound effects, and audio elements provided within the Company’s official in-app music library in the content created, edited, or uploaded on the Platform. The use of any third-party, unlicensed, or external audio is strictly prohibited. Uploading or syncing music from outside sources, including commercial tracks, royalty-free music acquired elsewhere, or personal audio files, is not allowed. Violations of this music usage policy may result in the removal of content and may lead to the suspension or termination of your account. The Company is not responsible for any legal issues or claims that arise from the use of unapproved audio. You are responsible for ensuring all audio in their content complies with this policy.

    8. The Platform may have a variety of categories, experiences and Users on the Platform to interact with, follow, and procure services/managed experiences from. You acknowledge that Company does not recommend or endorse any flights, hotels, rental companies, events, tours, workshops, experiences, or other category of services/experiences listed on the Platform. 

    9. You shall make an informed decision regarding the Creator or Host whose services you wish to avail of through the Platform and you shall make all bookings and payments for any such services packages or managed experiences only through the Platform. 

    10. You can provide feedback and leave a review regarding the services, packages or managed experiences booked through the Platform.

    11. You agree and acknowledge that the Company is only a facilitator and does not provide any representation, warranty or undertaking in relation to the availability, quality, status, features, or adequacy of any service or experiences listed on or booked through our Platform.


  2. Refunds, Cancellations and Amendments

    1. The terms and conditions governing refunds, cancellations and amendments shall be Host-specific and may vary depending on the nature of the services offered by individual Hosts, including but not limited to tours, experiences, accommodations, transportation or food services. Such terms will be disclosed at the time of booking and reflected on the Platform or in the Host’s listing.

    2. While the Company may facilitate the process, the decision to allow a refund or approve amendments shall be governed by the specific cancellation and refund policy of the respective Host. The Company does not guarantee any refunds or changes unless expressly stated in the Host’s policy.

    3. In certain cases where the Company collects payment on behalf of the Host, the Company may, at its sole discretion and in good faith, determine eligibility for a refund or amendment, including the amount to be refunded, subject to the Host’s policies. Such determinations shall be final and binding on the User.

    4. Approved refunds will only be processed in the name of the primary User or guest mentioned in the original booking, regardless of who made the payment. This applies to bookings made directly or through third-party agents, franchisees, or affiliates. The Company shall not be liable for any promises or deviations made by such third parties that contradict the official refund policy. 

    5. By proceeding with a booking through the Platform, the User acknowledges and agrees to comply with the applicable refund, cancellation and amendment terms, including Host-specific and third-party provider policies and waives the right to dispute refund determinations made in good faith in accordance with these Terms.


  1. Specific Terms and Conditions for Hosts

    1. As a Host, providing managed experiences (“Experience”) through any content uploaded on the Platform, your roles, responsibilities and obligations include the following:

      1. You shall provide accurate, complete, and up-to-date descriptions of all Experiences listed by you on the Platform. This includes all relevant details including categorisation, activity descriptions, pricing, availability, inclusions and exclusions, meeting points, duration, terms, conditions, cancellations, date change policy, limitations, refunds and any special requirements, instructions, restrictions, or other relevant details. This includes making any changes to the inventory, including but not limited to participant capacity, time-specific availability or seasonal availability, resource-based restrictions, age or physical requirement limits.

      2. You may provide a variety of properties listings (“Property Listings”). These Property Listings may include, but are not limited to, hotels, vacation rentals (such as apartments, homes, villas), resorts, guesthouses, bed and breakfasts, hostels, boutique stays, exclusive or luxury properties. You are responsible for setting your price and establishing rules and requirements for your Property Listing. You must clearly describe any and all additional fees and charges. You are also responsible for ensuring that all mandatory fees and charges applicable to your listing are included in your price breakdown. You may not collect any fees or charges outside the Platform. 

      3. You are responsible for ensuring that the information presented to Users is truthful and not misleading in any manner. Any material inaccuracies, omissions, or outdated content that negatively impacts the user experience or leads to customer dissatisfaction may result in corrective action, including modification, suspension, or removal of your listings. 

      4. The Company is not under any obligation to monitor or moderate the content submitted by the Host. However, the Company reserves the right to edit, remove or refuse to post any content on the Platform at its sole discretion, particularly if such content is found to be in violation of any applicable laws, including the Information Technology Act, 2000, the Intermediary Guidelines and Digital Media Ethics Code Rules, 2021 or any other rules, regulations, or policies of the Company. The Company shall act in accordance with its due diligence obligations as an intermediary under applicable law. 

      5. You are solely responsible for ensuring that all Experiences, including Property Listings, offered through the platform comply with all applicable laws, regulatory, and industry-specific requirements. This includes, but is not limited to, obtaining and maintaining any required permits, licenses, insurance policies, and certifications necessary for operating the Experience safely and lawfully. You are also responsible for adhering to all health and safety regulations to protect the well-being of Users and your staff. Failure to comply with these obligations will be treated as a serious breach of these Terms.

      6. You represent and warrant that your use of the Platform shall all times comply with the applicable laws, rules and regulations of their respective countries, including but not limited to data protection, IT and online content laws.

      7. You shall fulfill all User bookings with high standards of care, professionalism, and attention to detail. This includes timely communication with Users, honoring all confirmed reservations, providing the Experience as described without unauthorized changes, and you shall be responsible for addressing any and all issues or complaints promptly and respectfully. 

      8. Consistent failure to deliver quality service may result in negative reviews, penalties, and potential suspension or removal from the Platform at our sole discretion.

      9. You are solely responsible for obtaining and maintaining all necessary permissions, licenses, and certifications required to operate their Experiences and activities under applicable laws and regulations.

      10. All Experiences comply with all applicable local, state and national laws, governmental compliances, safety regulations, including but not limited to safety standards, environmental laws, tourism regulations, and business permits. The Platform reserves the right to request proof of such licenses and permissions, and the Host agrees to provide documentation upon request. Failure to provide necessary documentation may result in immediate suspension or termination of your Account.

      11. You shall implement and adhere to all safety protocols, including but not limited to providing the necessary safety equipment, trained staff, and precautionary measures during the Experiences.

      12. You are responsible for providing any necessary support to Users during the Experiences, including ensuring adequate safety measures are in place. This includes providing a risk assessment, addressing emergencies, and ensuring compliance with local safety standards.

      13. You are responsible for maintaining valid insurance coverage for the Experiences, including for Property Listings, which must cover User injuries, damages, and other liabilities.

      14. You agree to fulfil all confirmed bookings for Experiences in accordance with the details provided on the Platform. You shall ensure that the services are provided in a timely, professional, and satisfactory manner.

      15. You shall not solicit, prompt or otherwise discourage the Users from making their bookings through the Platform, and shall promote the Platform as a means of transacting with the Host.

      16. You agree to only accept payments through the Platform for all bookings made through the Platform.

      17. You shall treat all your customers equally and shall not discriminate against any User, regardless of how they booked the Experience.

      18. You shall be responsible for service fulfilment as per the promised standard (as measured by User feedback, complaints, or failure to deliver the Experience as described).

      19. You represent and warrant that any content uploaded, submitted or otherwise provided through the Platform is your original work or is properly licensed. You warrant that the content uploaded by you does not infringe upon any third-party intellectual property, proprietary or other rights. You shall be solely responsible for your content posted on the Platform and any consequences thereof.

      20. By uploading content, you grant the Company a worldwide, perpetual, royalty-free, non-exclusive license to: (a) use, reproduce, modify, adapt, publish, translate, create derivative works, and distribute the content; (b) display the content on the Platform, associated websites, and social media channels; (c) use the content in marketing, promotional materials, and commercial projects.       22. Music Usage Policy: You shall only use the music tracks, sound effects, and audio elements provided within the Company’s official in-app music library in the content created, edited, or uploaded on the Platform. The use of any third-party, unlicensed, or external audio is strictly prohibited. Uploading or syncing music from outside sources, including commercial tracks, royalty-free music acquired elsewhere, or personal audio files, is not allowed. Violations of this music usage policy may result in the removal of content and may lead to the suspension or termination of your account. The Company is not responsible for any legal issues or claims that arise from the use of unapproved audio. You are responsible for ensuring all audio in their content complies with this policy. You expressly agree to indemnify, defend and hold harmless the Company, its directors, officers, employees and affiliates from and against any claims, liabilities, damages, penalties, costs or expenses (including reasonable legal fees) arising out of or in connection with any breach of this clause, including but not limited to the unauthorized or infringing use of music or audio content.

      23. You acknowledge and understand that the Company uses in-house AI or GAI to assist you in generating details and information for your content based on your inputs. However, you shall review such content and finalise the content in such Experiences before submitting it for listing on the Platform. Further, the Company shall review your Experience before it gets published on the Platform. The Company shall have the exclusive right to modify, edit, or otherwise alter the content/Experience, in whole or in part, at its sole discretion, before releasing it publicly on the Platform or other websites.

  1. Furthermore, for a Host listing a Property Listing on the Platform, you agree to adhere to the following:

    1. You must either be the lawful owner of the property or have valid legal authorization to list it for short-term or long-term accommodation. You are solely responsible for ensuring that you have all necessary permits, licenses, or consents required under local municipal or housing laws to offer the property for rent.

    2. You are responsible for providing accurate and complete details of your property, including the location, type of accommodation, number of guests allowed, amenities, photos, pricing, availability calendar, house rules, and any special requirements. The content must not be misleading or deceptive in any manner. All photographs must reflect the true condition of the property. Any material misrepresentation may lead to removal of your listing, Account suspension, or legal consequences.

    3. You agree to maintain the property in a safe, clean, and fully functional condition for the Users. You must ensure that amenities listed are operational and that the property is ready for occupancy at the time of check-in. It is your responsibility to manage guest communications, check-in/out procedures, and ensure a smooth stay experience. You are also expected to respond promptly to any issues or complaints raised by the Users. You shall maintain a high level of professionalism and hospitality to retain credibility and avoid penalties or delisting.

    4. To maintain the trust and integrity of the platform, you are required to undergo ID verification. This may include submitting a government-issued identification document and, where applicable, documentation proving ownership or legal control over the property being listed. The Company may also conduct background checks or request additional verification at any time.

    5. You shall manage your account actively, including updating contact details and listing information, and promptly responding to inquiries or booking requests. You are responsible for regularly monitoring your listings, responding promptly to new reservations, and preparing the property or experience as per the listing details to ensure a positive User experience.

    6. Any changes to bookings such as dates, pricing, guest count, or property details must be made through the Platform, with mutual agreement between you and the User. All modifications must be clearly logged and confirmed on the Platform.

    7. You are expected to honor all confirmed bookings. Cancellations must be handled in line with the Company’s cancellation policy. If you have to cancel due to unforeseen circumstances, both the User and the Company shall be informed immediately. Repeated or last-minute cancellations may result in penalties, reduced listing visibility, or suspension. Users should be clearly informed of refund eligibility at the time of booking.

    8. You are required to assess and address any safety concerns on their premises before listing the property. This includes checking for potential hazards such as faulty wiring, fire risks, unsafe balconies or staircases, and ensuring that emergency exits are clearly marked and accessible. Smoke detectors, fire extinguishers, and first-aid kits should be installed and maintained at all times.

    9. The Company strongly recommends that you follow a set of safety tips and guidelines, including conducting a safety walkthrough before each User check-in, installing secure locks and surveillance (where legally permitted), providing emergency contact information within the property, and offering clear instructions on how to use appliances and utilities safely. You shall also establish and communicate emergency protocols to guests, including evacuation procedures and local emergency numbers.

    10. In the event of a safety issue or any misconduct, you shall immediately report the issue through the Platform’s reporting system. This may include situations such as property damage, theft, illegal activities, or violations of house rules by the Users. The Company may investigate the matter, take necessary action including suspending accounts, and, where required, assist with coordination with local law enforcement.

    11. We recommend that you obtain appropriate insurance coverage, including property damage, public liability, and theft insurance. The Company does not provide any insurance for your property or contents or any kinds of injuries occurring during the activities, itineraries, events or workshops hosted on Platform. You agree that any claims, losses, damages, or liabilities arising out of the User’s stay are solely your responsibility. You will not hold the Company liable for any damages, loss of income, theft, or injury occurring at the property.

    12. You acknowledge that the review system is an integral part of the Platform’s ecosystem. Users are encouraged to leave honest feedback based on their experience. You may also leave reviews of the Users. All reviews must comply with the Platform’s guidelines, and any attempt to manipulate or fabricate reviews is strictly prohibited.


  1. Specific Terms and Conditions for Creators

  1. As a Content Creator, your roles, responsibilities and obligations includes the following:

    1. Content Ownership and Responsibility: You represent and warrant that any content uploaded, submitted or otherwise provided through the Platform is your original work or is properly licensed. You warrant that the content uploaded by you does not infringe upon any third-party intellectual property, proprietary or other rights. You shall be solely responsible for your content posted on the Platform and any consequences thereof.

    2. Content Licensing to the Platform: By uploading content, you grant the Company a worldwide, perpetual, royalty-free, non-exclusive license to: (a) use, reproduce, modify, adapt, publish, translate, create derivative works, and distribute the content; (b) display the content on the Platform, associated websites, and social media channels; (c) use the content in marketing, promotional materials, and commercial projects. The Company may do so either manually through human intervention or through the application of AI or GAI technologies, as the Company deems necessary, for the purpose of listing, promoting, and showcasing the experiences on its Platform. This includes, but is not limited to, the creation of custom visuals, captions or alterations to the format of the content, to best align with the presentation and functionality of the Platform. You acknowledge that you have no right to any compensation, credit, or acknowledgment for any use of your content under this license.

    3. Waiver of Moral Rights: To the maximum extent permitted by applicable law, you waive any “moral rights” or similar rights you may have in your content, such as the right to object to modifications, transformations or other changes to your content.

    4. Content Moderation: The Company is not under any obligation to monitor or moderate the content submitted by the Creator. However, the Company reserves the right to edit, remove or refuse to post any content on the Platform at its sole discretion, particularly if such content is found to be in violation of any applicable laws, including the Information Technology Act, 2000, the Intermediary Guidelines and Digital Media Ethics Code Rules, 2021 or any other rules, regulations, or policies of the Company. The Company shall act in accordance with its due diligence obligations as an intermediary under applicable law.

    5. You represent and warrant that your use of the Platform shall all times comply with the applicable laws, rules and regulations of their respective countries, including but not limited to data protection, IT and online content laws.

    6. Music Usage Policy: You shall only use the music tracks, sound effects and audio elements provided within the Company’s official in-app music library in the content created, edited or uploaded on the Platform. The use of any third-party, unlicensed or external audio is strictly prohibited. Uploading or syncing music from outside sources, including commercial tracks, royalty-free music acquired elsewhere, or personal audio files, is not allowed. Violations of this music usage policy may result in the removal of content and may lead to the suspension or termination of your account. The Company is not responsible for any legal issues or claims that arise from the use of unapproved audio. You are responsible for ensuring all audio in their content complies with this policy. You expressly agree to indemnify, defend and hold harmless the Company, its directors, officers, employees and affiliates from and against any claims, liabilities, damages, penalties, costs or expenses (including reasonable legal fees) arising out of or in connection with any breach of this clause, including but not limited to the unauthorized or infringing use of music or audio content.

  1. As an Influencer, your roles, responsibilities and obligations includes the following:

    1. You are required to disclose any material connections you have with brands, which include financial, employment, family, or personal relationships. This disclosure must be clear, easy to understand, and prominently placed within the content itself, not hidden or buried.

    2. You shall ensure that all endorsements made by you are honest and truthful. You shall only promote products or services that you have personally used or genuinely support, and you must not make false or misleading claims. 

    3. In addition to honesty and clarity, influencers must be aware of and comply with all applicable consumer and advertising laws in the regions where their content is viewed or consumed.

  1. As a Partner, your roles, responsibilities and obligations include the following:

    1. You agree that you shall ensure that the Content Creator/Influencer engaged by you provides all relevant details about each Experience (defined below), including pricing, duration, availability, terms, conditions, cancellations and date change policy and other limitations on the Platform.

    2. You are responsible for ensuring the accuracy of the Experience information provided on the Platform by a Content Creator/Influencer engaged by you, and for making any changes to availability, conditions, rescheduling or cancellation of any event or limitations, particularly with respect to the maximum number of participants to keep the information up to date.

    3. If you fail to update the inventory, resulting in overbooking or misrepresentation of availability, you shall be responsible for resolving the issue, if necessary, will cooperate with the Company to find a suitable solution. Any costs or liabilities arising from such mismanagement will be borne solely by you.

    4. You, and the Content Creator/Influencer engaged by you, shall ensure that all Experiences comply with applicable laws, safety regulations, and local ordinances.

    5. You are responsible for providing any necessary support to Users during the Experiences, including ensuring adequate safety measures are in place.

  1. As a Creator providing Experiences through any content uploaded on the Platform, you agree that:

    1. You shall provide all relevant details about each Experience listed by you on the Platform, including categorisation, pricing, duration, availability, terms, conditions, cancellations, date change policy, limitations and other relevant details.

    2. You acknowledge and understand that the Company uses in-house AI or GAI to assist you in generating details and information for your content based on your inputs. However, you shall review such content and finalise the content in such Experiences before submitting it for listing on the Platform. Further, the Company shall review your Experience before it gets published on the Platform. The Company shall have the exclusive right to modify, edit, or otherwise alter the content/Experience, in whole or in part, at its sole discretion, before releasing it publicly on the Platform or other websites.

    3. You are responsible for ensuring that the information and content related to an Experience listed on the Platform is accurate and up to date, including making any changes to the inventory, including but not limited to participant capacity, time-specific availability or seasonal availability, resource-based restrictions, age or physical requirement limits.

    4. You are solely responsible for obtaining and maintaining all necessary permissions, licenses, and certifications required to operate their Experiences and activities under applicable laws and regulations.

    5. You represent and warrant that your use of the Platform shall all times comply with the applicable laws, rules and regulations of their respective countries, including but not limited to data protection, IT and online content laws.

    6. All Experiences comply with all applicable local, state and national laws, governmental compliances, safety regulations, including but not limited to safety standards, environmental laws, tourism regulations, and business permits. The Platform reserves the right to request proof of such licenses and permissions and the Creator agrees to provide documentation upon request. Failure to provide necessary documentation may result in immediate suspension or termination of your Account.

    7. You shall implement and adhere to all safety protocols, including but not limited to providing the necessary safety equipment, trained staff and precautionary measures during the Experiences.

    8. You are responsible for providing any necessary support to Users during the Experiences, including ensuring adequate safety measures are in place. This includes providing a risk assessment, addressing emergencies, and ensuring compliance with local safety standards. 

    9. You are responsible for maintaining valid insurance coverage for the Experiences, which must cover User injuries, damages, and other liabilities.

    10. You agree to fulfil all confirmed bookings for Experiences in accordance with the details provided on the Platform. You shall ensure that the services are provided in a timely, professional, and satisfactory manner.

    11. You shall be responsible for service fulfilment as per the promised standard (as measured by User feedback, complaints, or failure to deliver the Experience as described).

  1. The Host and Creator shall also adhere to the inventory management and API synchronization terms provided below: 

    1. You shall maintain accurate and up-to-date information about the availability, capacity, and conditions of each Experience using the Company’s inventory management tool, unless API synchronization is available. This tool is the sole method for tracking availability, and any data not entered or confirmed in it is not considered valid.

    2. The Company will rely on the inventory details provided by the Host/Creator through the tool. When a User books an Experience, the availability must be confirmed as “booked” in the inventory management tool. Once confirmed, the booking will be considered final, and the Experience will no longer be available for sale to other Users unless additional spots or dates are updated by the Host/Creator. Such updates must be made by the Host/Creator in the inventory management tool within 30 (thirty) minutes of the booking confirmation.

    3. If you fail to update the inventory, resulting in overbookings or inaccurate listings, you shall be solely responsible for resolving the issue, if necessary, the Host/Creator will cooperate with the Company to find a suitable solution. Any costs or liabilities arising from such mismanagement will be borne solely by the Host/Creator. 

    4. The Host/Creator agrees to immediately communicate any changes in availability, capacity, or other conditions directly through the tool to ensure the Platform reflects up-to-date information when showing the Experiences.

    5. Only Hosts/Creators without API capabilities will use the tool and are fully responsible for manually entering accurate data. Hosts/Creators with partial API synchronization must use the tool to update unsynchronized information. Full API-integrated Hosts/Creators are exempt from using the tool, as their data is updated automatically.

    6. The Host/Creator acknowledges that the conditions set forth in this section regarding inventory management and booking confirmations apply exclusively to Hosts/Creators who choose to use the inventory management tool provided by the Company. By selecting this tool, the Host/Creator agrees to comply with the requirements for maintaining accurate and up-to-date availability information, as outlined in these Terms.

    7. The inventory management tool will be provided exclusively to the Hosts/Creators who do not have the capability to offer partial or complete API synchronization. Hosts/Creators with API integration are not required to use the inventory management tool, as all relevant data concerning the Experiences, including availability, pricing, and conditions, will be automatically updated through the API. Only those Hosts/Creators without API capabilities will be granted access to the inventory management tool, and they will be responsible for ensuring the accuracy of the information entered in it.

  1. The Company reserves the right to remove any content or Experience from the Platform that fail to meet the required safety standards or violates these Terms.


  1. Privacy and Cookie Policy

    1. The Company respects your privacy and has accordingly formulated a privacy and cookie policy, in compliance with the applicable laws (the “Privacy and Cookie Policy”).

    2. The use of any personal information shall be governed by the Privacy and Cookie Policy as provided on this Platform and amended from time to time.

    3. You may revisit and access the Privacy and Cookie Policy of the Company at https://aarna.global/.  


  2. Remedies

    1. In the event you are found to have violated or threatened to violate any of the Terms, the Company reserves the right to do any or all of the following: 

      1. Take any action remediating any violation in such a manner that it may deem fit and necessary including all necessary legal, civil and criminal actions, 

      2. Terminating your registration from using the Services and the Platform temporarily and permanently, and 

      3. Seek indemnification and/or compensation to the extent of loss or damage caused to the Company. 

    2. You acknowledge that in no event shall the Company be liable for any damages whatsoever whether direct, indirect, general, special, compensatory, consequential, punitive or incidental, arising out of or relating to the conduct of You or anyone else in connection with the use of the Services. 


  3. Information Security

    1. The Company acknowledges that it employs an industrial standard security protocol and is in compliance with the laws governing information technology and/or data protection and privacy to ensure that the information that are stored, transmitted or transferred through the Platform is protected and the same is hosted on a secure server. 

    2. The Company shall not be held responsible for the loss of your information that takes place despite following standard security protocol.  

    3. In order to keep your Account safe, you agree to maintain the confidentiality of the username and password, and to change the password of the Account periodically.

    4. You will be solely responsible for maintaining the confidentiality of the username and password, and for all activities that occur from the Account. 


  4. Links to Third Party Websites

    1. The Platform may have links to third party websites/applications or service providers, including advertisers (collectively, “Third-Party Websites”). The Company does not endorse any Third-Party Websites that you may be redirected to.

    2. You agree to exercise your independent judgment and prudence when visiting / using any Third-Party Websites via a link available on the Platform. Your usage of such Third-Party Websites and all content available on such Third-Party Websites is subject to the terms of use of the respective Third- Party Website and the Company is not responsible for your use of any Third-Party Websites.


  5. Intellectual Property

    1. The Company, its technology, computer programs, codes, all information available thereon, images, logos, trade names, domain names, service marks and other materials on it, including the look and feel of the Platform, are the exclusive intellectual property of the Company and/or its affiliates. 

    2. Any unauthorized reproduction, republication, distribution, display, transmission, sale, or any other use and/or duplication of any material available on Platform, without express and written approval of the Company shall be violation of the relevant intellectual property laws. The Company and its associates reserve the right to initiate and pursue any and all necessary legal and/ or other action against any such user for infringement of Company and/ or its associates’ intellectual property.  


  6. Termination

    1. The Terms shall remain in full force and effect unless and until the Account is terminated in accordance with the Terms. 

    2. You may deactivate the Account and terminate your registration with the Company at any time, for any reason, by using the in-app “Delete Account” feature and confirming your password. Such termination shall take effect after a period of 7 (seven) days from the date of notice, to allow for the removal of all content associated with your Account from the Platform. Further, such termination shall not absolve you of any liability towards the Company arising from the Services or your use of the Platform. 

    3. The Company may also suspend or terminate your use of the Platform, and/or the Account, at any time, for any breach of these Terms. 

    4. Subject to applicable law, the Company reserves the right to maintain, delete or destroy all communications or materials posted or uploaded on to this Platform pursuant to its internal record retention and/or content destruction policies. After such termination, the Company will have no further obligation to provide the Services to you. 

    5. The Company further reserves the right to terminate these Terms or discontinue the Services provided through this Platform or any portion or feature thereof for any or no reason and at any time without any liability towards you or any other third-party.

    6. Post your account is deleted (regardless of the reason), you will no longer have access to your account on the Platform and your Content as generated may no longer be available; any deletion once processed is irrecoverable. Platform is not responsible for the loss of your information and/or your Content upon deletion and Platform shall not be liable to any party in any way for the inability to access your Content arising from any deletion.

    7. Please note that we may not be able to delete all communications or photos, files, or other documents publicly made available by you on the Platform, however, we shall anonymize your Personal Information (as defined in the Privacy and Cookie Policy) in such a way that you can no longer be identified as an individual in association with such information made available by you on the Platform. We will never disclose aggregated or de-identified information in a manner that could identify you as an individual.

    8. If you are a Content Provider, your access and use of the Platform may be subject to a separate agreement with Platform and shall be collectively governed by the terms of such agreement, the Terms and Conditions and other Platform Terms.

    9. The Company will not be liable to you for any costs, expenses, or damages as a result of the termination of these Terms. 


  7. Disclaimer & Warranties

    1. The content and all the Services associated with the Platform are provided to you on an “as-is” and “as available” basis. The Company makes no representations or warranties of any kind, express or implied, as to the content or operation of the Platform or of the Service. You expressly agree and acknowledge that your use of the Service is at your sole risk. 

    2. The Company makes no representations, warranties or guarantees express or implied, regarding (a) the accuracy, reliability or completeness of the content on the Platform, including Content provided by other Users, Creators or Hosts, or (b) of the Services expressly disclaims any warranties of non-infringement or fitness for a particular purpose. 

    3. The Company engages and employs the best methods to safeguard and protect against viruses, infection, et cetera, however, despite such best efforts, the Company makes no representation, warranty or guarantee that the content that may be available through the Service is free of infection from any viruses, bugs or other code or computer programming routines that contain contaminating or destructive properties or that are intended to damage, surreptitiously intercept or expropriate any system, data or personal information. 

    4. Our Platform does not constitute and should not be regarded as a recommendation or endorsement of any flights, hotels, rental companies, events, tours, workshops, experiences, or services listed on our Platform. The Company hereby expressly disclaim any representation, warranty or undertaking in relation to the availability, quality, status, features, or adequacy of any service or experiences listed on or booked through our Platform.

    5. The Company acts solely as an independent intermediary between various types of Users, Creators and Hosts. The Company does not guarantee the descriptions, conditions, suitability, pricing, or fulfilment of any services provided by other Users, Creators or Hosts. The Users are entering into a direct contractual relationship with the applicable Hosts or Creators for each booking made via the Platform.

    6. The Platform operates as an intermediary under the Information Technology Act, 2000 and the Intermediary Guidelines and Digital Media Ethics Code Rules, 2021. The Company does not control or endorse user-generated content and shall not be liable for any such content. The Company will act upon valid takedown requests in accordance with applicable law.

    7. By using the Platform, you acknowledge and agree that the Company shall not be held liable for: (a) any acts, omissions, errors, warranties, representations, breaches, or negligence of any other Users, Creators or Hosts; or (b) any personal injuries, death, property damage, or other damages or expenses resulting from your interactions with other Users, Creators or Hosts.

    8. You are encouraged to carefully review the listings, services and/or experiences own terms and policies as provided by such Users, Creators or Hosts before completing any booking.


  8. Indemnification

    1. You shall indemnify and hold harmless the Company and/or its affiliates, directors, employees, and agents against any loss or damage suffered on account of fraud, willful neglect and loss of data done and/or caused by you and against all damages, losses, and expenses of any kind, including reasonable legal fees and costs, related to such claim brought against the Company by any third party.

    2. You agree to indemnify, defend, and hold harmless the Company, its officers, employees, agents, and affiliates from and against any and all claims, demands, actions, liabilities, damages, losses, costs, or expenses, including but not limited to legal fees, arising out of or in connection with the following:

      1. Any content provided by you is inaccurate, misleading, or false in nature.

      2. Any claim or violation related to the infringement of third-party intellectual property rights, including copyrights, trademarks, patents, or trade secrets, in connection with your materials, content or services.

      3. Any violation of applicable laws, regulations, or industry standards by you in connection with the materials, content or services provided.

      4. Any failure or delay in the proper delivery, execution, or fulfilment of Experiences associated with the Host’s or Creator’s services, including any associated damages or losses suffered by the Company or third parties.


  9. Limitation of Liability

    1. Neither the Company nor any of its affiliates/representatives shall be liable for:

      1. any indirect, incidental, special, consequential or punitive damages resulting from the use or the inability to use the Platform and/or damages for lost profits, loss of data, goodwill or other intangible losses by the User, Creator or Host;

      2. any harm, injury, loss, or death arising out of or during participation in any experience, activity, or service offered on the Platform. All such liability shall rest solely with the respective Host or Creator providing the service. Users voluntarily participate in such services at their own risk and are advised to exercise due caution and judgment; 

      3. user interaction and associated issues the User, Creator or Host has with any Third-Party Websites accessed through the Platform;

      4. any unauthorized access to or alteration of the User’s, Creator’s or Host’s transmissions or data; 

      5. any User-generated, Creator-generated or Host-generated content;

      6. third party services accessed via APIs; or 

      7. any other matter relating to the Platform or the Service.

    2. Additionally, the Company shall not be held liable for any misrepresentation, infringement, or legal claims arising from any modifications, alterations, or new content created by the Company based on your provided materials for the purpose of listing such content on the Platform. You agree that the Company shall have no liability for any legal issues, disputes, or claims related to such content, including any claims of misrepresentation or infringement arising from these modifications.

    3. The Host and Creator assume full responsibility and liability for any incidents, injuries, death, or harm that may occur to Users during their participation in the Experiences offered through the Platform. The Host and Creator agree to indemnify, defend, and hold the Company harmless from any claims, damages, or legal actions arising from such incidents, including but not limited to those related to their actions, negligence, or failure to comply with applicable laws and regulations. The Company shall not be held liable for any injury, death, or harm sustained by Users during participation in the Experience.


  10. Governing Law and Jurisdiction 

    1. These Terms shall be governed by, interpreted and construed in accordance with the laws of India. 

    2. In case of any dispute, claim or controversy arising out of or relating to these Terms or the breach, termination, enforcement, interpretation or validity thereof or the use of the Platform (collectively, “Disputes”), the Company and you shall attempt to settle the same amicably, through negotiation and consultation at such offices of the Company as the Company may designate. 

    3. In the event the dispute remains unresolved for 30 (thirty) days, either party may refer to such dispute to the courts at Hyderabad, Telangana, unless otherwise mutually agreed by the Company and you in writing.  


  11. Non-repudiation

    1. Any and all actions undertaken by you and/or your affiliates, admin, on the Platform shall be deemed as actions approved by you including and not limited to transfer/change of passwords and the Company shall not have any liability towards such actions. 


  12. Miscellaneous 

    1. The Company reserves the right to amend, update or modify these Terms at any time, at its sole discretion, without prior notice. Any such changes will become effective upon being posted on the Platform. It is the User’s, Host’s and Creator’s responsibility to review the Terms periodically and continued use of the Platform after such updates shall constitute acceptance of the revised Terms. If you do not agree to the modified Terms, you must stop using the Platform immediately.

    2. These Terms shall be interpreted, construed and enforced in accordance with the laws as applicable in India without regard to conflict/choice of law principles. In a situation where any provision of this Agreement is found to be invalid or unenforceable, such provision shall be severed from the remaining Agreement, which shall remain in full force and effect.

    3. No waiver of any breach or default of the Agreement shall be deemed to be a waiver of any preceding or subsequent breach or default. The section headings used in this Agreement should not be used for any interpretative purposes as these are for your convenience only.

    4. In the event that any provision of these Terms is held to be invalid or unenforceable, then that provision will be limited or eliminated to the minimum extent necessary, and the remaining provisions of these Terms will remain in full force and effect.

    5. All the rights and obligations of the Company under these Terms are freely assignable by the Company in connection with a merger, acquisition, or sale of assets, or by operation of law or otherwise.

    6. The Company reserves the right to research and publish general user behavior categorized at its discretion.

    7. By using the Platform, you agree to receive accounts and feature e-mails, calls, messages and flash messages from the Company.

    8. The Platform uses temporary cookies to store certain data (that is not sensitive personal data or information) that is used by the Company for the technical administration of the Platform, research and development, and for user administration. In the course of serving advertisements or optimizing the Services to you, the Platform may allow authorized third parties to place or recognize a unique cookie on your web browser. The Company does not store personally identifiable information in the cookies.  

    9. You may report any abusive, offensive or inappropriate content encountered on the Platform through the in-app reporting mechanism or by contacting the Company’s grievance officer at grievancofficer@aarna.global The Company will take appropriate action in accordance with applicable laws and its content moderation policies.


  13. Entire Agreement

    1. These terms, including Terms of Use and Privacy and Cookie Policy, constitutes the entire agreement between you and the Company and governs your use of the Platform, superseding any prior agreements between you and the Company with respect to the Platform.  


By accessing or using the Platform, you acknowledge that you have read, understood and agreed to be bound by these Terms and Conditions, as amended from time to time.
